Severance pay (kıdem tazminatı) is governed by Article 14 of the former Labour Law No. 1475, which remains in force. The basic condition is at least one year of service with the same employer.
When is it payable?
- Termination by the employer, except for reasons of misconduct
- Termination by the employee for just cause, such as unpaid wages
- Leaving for compulsory military service
- Retirement or meeting the insurance requirements for a pension
- A female employee leaving within one year of marriage
- Death of the employee (payable to heirs)
Calculation
For each full year of service, 30 days of gross wage including regular benefits is paid, capped at the ceiling announced for each period. Claims are subject to a five-year limitation period, and mediation is mandatory before filing a lawsuit.
